Privacy Policy

At AFRICLOUD LLC, we prioritise your privacy and the security of your personal data. This Privacy Policy outlines how we collect, use, and safeguard your information when you interact with our services, in compliance with applicable US laws, including those of the State of Wyoming, and EU Regulations such as the General Data Protection Regulation (GDPR).

Data Collection: We collect personal details including your name, email address, physical address, company name, payment details, IP address, and browsing behaviour through our billing platform for account management. Google Analytics is utilised to track website usage, and we may share limited data (e.g., email addresses and cookies) with Google Ads and X for customer mapping and advertising targeting, in each case only where you have consented to analytics and advertising cookies.

Service Providers: We use third parties to deliver parts of the service, and they process personal data on our behalf under contract. These are: our card processor (Stripe) and PayPal for payments; our cryptocurrency payment processor and our mobile-money payment processor for those payment methods; Google for analytics and advertising; X for advertising measurement; and Tawk.to for live chat. Each receives only the data needed for its function.

Where Your Data Is Held: Customer servers, and the data you store on them, are hosted in the region you select: Lisbon (Portugal), Johannesburg (South Africa) or Lagos (Nigeria). We operate no server infrastructure in the United States.

International Transfers: Several of the service providers named above are established in the United States, so limited account, billing and website-usage data is processed there. This is separate from where your servers are hosted, which is covered above.

Data Retention: Personal data is retained for the duration of the client's active services with AFRICLOUD LLC or until the client expressly requests deletion of such data. Certain data may be retained for up to five (5) years for the processing of tax records, dispute resolution, fraud prevention, and similar legitimate purposes.

Data Security: AFRICLOUD LLC adheres to industry best practices for data security. Measures include, but are not limited to, data encryption (at rest and in transit), robust access controls, regular security audits, and comprehensive staff training.

Your Rights: In accordance with applicable laws, you possess rights concerning your personal data. You have the right to access, correct, or delete your personal data. You can export your data and request account deletion yourself from your dashboard, subject to a 30-day grace period before deletion takes effect. For anything you cannot complete yourself, we endeavour to respond within a reasonable timeframe, typically within 30 days as per GDPR guidelines.

Terms of Service

By utilising AFRICLOUD LLC's services, you hereby agree to these Terms of Service. Please read them carefully.

Age Requirement: You must be at least 18 years of age to use AFRICLOUD LLC's services.

Prohibited Activities: You may not use our services for any unlawful purposes, including but not limited to:

  • Copyright infringement
  • Hate speech
  • Defamation
  • Terrorist content
  • Spamming
  • Content scraping
  • Pornography
  • Hacking and phishing
  • Distributing malware

Scope of Illegality: "Illegal activities" are defined by the laws of Wyoming, the United States, the Portuguese Republic, and the European Union.

Self-Managed Services: Unless you have purchased a managed service from us, all virtual and dedicated servers are self-managed. You retain full administrative access and are responsible for the operating system, the software you install, your data and your configuration, including access control, patching and backups. Our responsibility covers the network, the physical infrastructure, the virtualisation platform and the customer dashboard. We do not access customer servers as a matter of policy, and will do so only where you expressly request it in writing for a specific purpose, or where a managed service you have purchased provides for it. This clause describes the division of responsibility between us and does not reduce the uptime commitment set out in our Service Level Agreement, which covers our own platform.

Software and Licensing (BYOL): AFRICLOUD provides Infrastructure-as-a-Service (IaaS) only. We do not provide, install, licence, or support any operating system or software. Where you install software on your server, you do so using your own valid licences (Bring Your Own Licence). You are solely responsible for obtaining, maintaining, and complying with all licences for any software you install, including ensuring your licences are eligible for use in a cloud or virtualised environment under the relevant licensor's terms, such as any requirements for support subscriptions or minimum core counts. We make no representations about licence eligibility and provide no assistance with licensing compliance. Any disputes with third-party licensors, including audit claims, are your sole responsibility.

Violation Notification: Should a violation be detected, you will be notified and expected to remove the violating content or cease the prohibited activity within 48 hours. Failure to do so may result in immediate suspension or termination of your service.

Limitations of Liability: To the maximum extent permitted by applicable law, AFRICLOUD LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or licensing penalties imposed by third-party licensors. Our total liability for any claim arising from these Terms shall not exceed the fees paid by you in the preceding 12 months.

Indemnification: You agree to indemnify, defend, and hold harmless AFRICLOUD LLC, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Services, any software you install (including licensing violations or claims by third-party licensors), your data or activities on the server, or any breach of these Terms. This indemnification survives termination of your service.

Force Majeure: AFRICLOUD LLC shall not be deemed in default of this Agreement for any delay or failure in performance resulting from acts of God, civil or military authority, war, riots, or any similar cause beyond reasonable control.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States.

Acceptable Use Policy

Our Acceptable Use Policy ensures fair and responsible use of AFRICLOUD's services.

Usage Limits:

  • Each plan includes a defined bandwidth cap. Exceeding this cap will result in the service being automatically throttled.
  • Server usage must not continuously consume 100% CPU. An average CPU load of 100% over a 30-minute period shall be considered a service violation.

Prohibited Actions: Activities violating the Terms of Service (e.g., spamming, hacking, phishing, malware distribution) are expressly forbidden. The following are also prohibited:

  • Installing or using software in violation of its licence terms, including pirated or unlicensed copies of any operating system or application.
  • Cryptocurrency mining, blockchain validation, proof-of-work computation, or any sustained computational workload designed primarily to generate cryptocurrency or digital tokens. This prohibition applies regardless of the mining method, algorithm, or currency involved. Cryptocurrency mining degrades performance for other customers on shared infrastructure and is incompatible with our fair-use resource allocation. Violations will be treated as a breach of the CPU usage limits above.

Consequences: Violations of this policy may lead to immediate suspension or termination of services without prior notice, at AFRICLOUD's sole discretion.

Service Level Agreement

AFRICLOUD LLC is committed to reliable service delivery.

Uptime Guarantee: We offer a 99.9% uptime guarantee, calculated monthly. "Downtime" refers to total service outages, excluding planned maintenance and other specific exclusions.

Remedies: If monthly uptime falls below 99.9%, service credits may be provided, assessed on a case-by-case basis. To claim service credits, clients must open a support ticket within seven (7) business days of the downtime event.

Exclusions: The uptime guarantee does not apply to downtime caused by user-caused issues, third-party network issues, scheduled maintenance, DDoS attacks, or Force Majeure events.

Maintenance: Scheduled maintenance is carried out outside typical business hours for the region concerned, and does not count toward downtime. We give advance notice of scheduled maintenance that is expected to interrupt service.

Redundancy: Our infrastructure features IP transit via MEO, DE-CIX fibre, and A+B power routes for enhanced reliability.

DMCA Policy

AFRICLOUD LLC adheres to the Digital Millennium Copyright Act (DMCA) and respects the intellectual property rights of others.

DMCA Notices: All DMCA notices and copyright infringement claims should be submitted through our support page. Please specify "DMCA Notice" in your submission.

Reporting Infringement: Your notice must include:

  1. A physical or electronic signature of the copyright owner or authorised person
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material to be removed (e.g., URL or IP address)
  4. Your contact details: name, address, telephone number, and email
  5. A good-faith belief statement
  6. A statement of accuracy under penalty of perjury

Action Taken: Upon receipt of a valid DMCA notice, we will review and take appropriate action, which may include removing or disabling access to the allegedly infringing content.

Repeat Infringers: AFRICLOUD LLC maintains a policy of terminating the services of repeat copyright infringers.

Anti-Money Laundering (AML) Statement

AFRICLOUD LLC is committed to preventing the misuse of our services for money laundering, terrorism financing, or sanctions evasion.

Compliance Commitments: We align our controls to applicable guidance and sanctions regimes, including U.S. (BSA/FinCEN), EU AMLD, UK MLR, and UN sanctions. We enforce country access controls and conduct screening through our payment providers.

Due Diligence: We may request additional information or documents (e.g., identity/address for individuals, business registration for companies) where risk indicators are present.

Payments: We accept card and PayPal payments via reputable processors with integrated screening. Cryptocurrency and mobile-money payments are processed through regulated providers with appropriate controls.

Billing Policy

AFRICLOUD LLC enforces strict payment terms for all services.

Payment Obligation: Services require advance payment. We accept credit and debit cards, PayPal, mobile money in the African countries where we support it, and cryptocurrency payments. Additional local methods, which may include Apple Pay, Google Pay, Klarna, SEPA Direct Debit, iDEAL and ACH, are offered where your country and billing currency support them. There is no fixed list: the methods available to you are determined at checkout and are shown there before you pay.

Suspension and Termination: Non-payment by the due date will result in immediate suspension of services. If payment remains overdue for 30 days, services will be terminated. Data will be irrevocably deleted after 45 days of non-payment.

No Grace Period: No extensions or grace periods are provided beyond the stated due date.

Payment Reminders: Users will receive five (5) automated reminders at regular intervals before services are suspended or terminated.

Refund Policy

AFRICLOUD LLC offers refunds under specific conditions, in compliance with consumer protection laws in Wyoming, the US, Portugal, and the EU.

Eligibility: Refunds are available within fifteen (15) active service days of service activation, specifically if the service fails to meet the technical specifications advertised for your plan. You must provide conclusive technical proof (e.g., logs or performance metrics) demonstrating the shortfall.

Exclusions: No refunds will be issued where there is confirmed abuse of AFRICLOUD's services. Non-refundable services or add-ons, such as domain registrations or third-party licenses, are also excluded.

Process: All refund requests must be submitted via our support page. Approved refunds will be processed within fifteen (15) days of approval.

Legal Note: This policy aligns with applicable consumer protection laws. No additional cooling-off periods beyond 15 days apply unless explicitly required by law.
