Customer support tools like Tawk.to (for AI Live Chat) and Grok (for basic ticket responses) may be used, but all support tickets are managed within WHMCS.

- Data Transfers: No personal data is transferred to the United States, as AfriCloud maintains no server footprint there.

- Legal Compliance: We comply with the General Data Protection Regulation (GDPR) and other applicable laws. You have the right to access, correct, or delete your personal data, and we retain it only as long as necessary to provide our services or meet legal obligations.

Terms of Service

By using AfriCloud LLC’s services, you agree to these Terms of Service:

- Prohibited Activities: You may not use our services for illegal purposes, including but not limited to:

  • Spamming
  • Content scraping
  • Pornography
  • Obtaining by false pretense
  • Hacking
  • Phishing
  • Distributing malware

- Scope: “Illegal activities” are defined by the laws of Wyoming, the United States, the Portuguese Republic, and the European Union. This list balances specificity with broad coverage of prohibited conduct.

- Enforcement: AfriCloud may suspend or terminate your service immediately upon detecting violations, without liability for damages caused by your misuse.

- Your Responsibility: You must ensure compliance with all applicable laws.

Acceptable Use Policy

Our Acceptable Use Policy ensures fair and responsible use of AfriCloud’s services:

- Usage Limits:

  • Each VPS plan includes a soft bandwidth cap. Exceeding this cap may result in throttled network speeds, depending on your plan.
  • VPS usage must not continuously consume 100% CPU, as this affects other users.

- Prohibited Actions: Activities violating the TOS (e.g., spamming, hacking, phishing, malware distribution) are forbidden.

- Consequences: Violations may lead to immediate suspension or termination without notice.

- Standard Clauses: These restrictions align with industry norms for shared hosting environments.

Service Level Agreement

AfriCloud LLC commits to reliable service delivery:

- Uptime Guarantee: We offer 99.5% uptime, calculated monthly. “Downtime” refers to total service outages, excluding planned maintenance.

- Remedies: If uptime falls below 99.5%, service credits may be provided, assessed case-by-case.

- Maintenance: Scheduled maintenance, if needed, occurs outside business hours (e.g., 00:00 Sunday, Lisbon time) and does not count toward downtime.

- Redundancy: Our infrastructure features IP transit via MEO, DE-CIX fiber, and A+B power routes for enhanced reliability.

DMCA Policy

AfriCloud LLC adheres to the Digital Millennium Copyright Act (DMCA):

- Reporting Infringement: If content on our services infringes your copyright, submit a notice to our contact form including:

  1. Description of the copyrighted work.
  2. Location of the infringing content.
  3. Your contact details.
  4. A good-faith statement that the use is unauthorized.
  5. A statement under penalty of perjury confirming accuracy.

- Action: We will promptly review valid notices and remove infringing content as required.

Billing Policy

AfriCloud LLC enforces strict payment terms:

- Payment: Services require advance payment. Non-payment by the due date results in immediate suspension.

- Termination: If payment remains overdue for 30 days, services are terminated. Data, including backups, is deleted after 45 days of non-payment.

- No Grace Period: No extensions are provided beyond the due date.

- Notification: Suspension or termination notices will be sent via our contact form.

Refund Policy

AfriCloud LLC offers a refund under specific conditions:

- Eligibility: Refunds are available within 15 days of service activation if the VPS fails to meet the technical specifications advertised for your plan. You must provide technical proof (e.g., logs or performance metrics) demonstrating the shortfall.

- Process: Submit refund requests via our contact form. Refunds will be processed within 30 days.

- Legal Note: This policy aligns with consumer protection laws in Wyoming, the US, Portugal, and the EU. No additional cooling-off periods beyond 15 days apply unless required by law (none identified in this context).
